Why Should Attorneys Attend the 2002 Lead-Safe Indiana Conference on November 6 & 7, 2002? Wisconsin has put landlords on notice that ignorance of lead-based paint hazard are no excuse. A court in New York has said that a health department is liable for not properly investigating and addressing cases of lead poisoning. A public nuisance lawsuit in Rhode Island against the lead paint manufacturers brought by the state attorney general goes to trial in September. While few lawsuits have been filed in Indiana, the potential is there. Health departments are mandated by state regulations manage lead poisoning cases and conduct an environmental investigations. Contractors are prohibited from using dangerous work practices on pre-1960 housing and child-occupied facilities. Landlords have a clearer responsibility to provide safe housing under a new Indiana law that affects leases signed after July 1, 2002. Doctors do not follow state guidelines regarding blood lead testing.
It is important to understand these potential liabilities and the chances of a lawsuit in Indiana. Whether you want more lawsuits or feel that there are too many, you need to get the facts. We believe much of the conference would benefit attorneys. We are filing for Continuing Legal Education Credit for several of the sessions. It will help you see the forest from the trees and give you a roadmap to help you through the rest of the conference. Learn about the new landlord responsibilities that went into effect on July 1, 2002 on Wednesday from 1:30 to 2:30. Find out about Indiana's new requirements that prohibit contractors from using dangerous work practices and require them to clean up their messes in pre-1960 housing on Wednesday from 2:40 to 3:40. Or get the basics on mold and the policy implications for the state in another session taking place at the same time. Understand the barriers that stop Indiana from meeting its Medicaid mandates regarding lead poisoning prevention on Wednesday from 3:50 to 4:50. Either hear from Indiana's leading doctors about their perspective on lead poisoning or better understand why federally mandated disclosure is not happening on Thursday from 9:00 to 10:30 12:15 to 1:30.
