What Does the SB-320 Require?

SB-320 primarily impacts all renovation and maintenance activities in Indiana on target housing (residences) and child-occupied facilities built before 1960.

  • Updates and Refines Lead Professional Licensing Requirements
  1. Requires licenses to last two years instead of one year. EPA provides for 3-year renewal.
  2. Establishes a clearance examiner license for non-abatement projects.
  • Prohibits Dangerous ActivitiesThe HUD-list of prohibited activities would be extended to all facilities built before 1960 even if not covered by HUD regulations. These activities include charring paint, dry sanding and dry scraping. In most situations, a homeowner still would be allowed to use these dangerous activities.
  • Requires Cleanup of Exterior Paint DebrisWhen disturbing exterior paint on all facilities built before 1960, all visible paint chips must be cleaned up within 48 hours of completing surface preparation.
  • Provides for Lead-Safe Interagency CoordinatorThe state is directed to establish the position of a lead-safe interagency coordinator. However, no funding is provided.
