Meridian Street is the premier address in Indianapolis.  It also has the most large apartment buildings in the City.  During the summer of 2004, IKE filed complaints with Marion County Health Department on observed lead hazards - primarily deteriorated paint - on the 25 apartment buildings on Meridian St. between 30th and 38th streets.   Others filed additional complaints.   

Based on the complaints, MCHD inspected the buildings described below and provided the landlord with a lead risk assessment and, if necessary, a repair order.  24 of the 25 buildings in the initial round of complaints had lead hazards and received repair orders.  The New Yorker was the exception. 

Every repair order should have a follow-up on the order by the MCHD indicated that:

• The work was properly completed and no lead hazards were found; or

• Additional work was needed to comply with the housing code. 

Federal law requires the landlord to provide tenants with a copy of the full risk assessment (often about 25 pages), repair order and follow-up documents when they sign or renew the lease.  If the risk assessment covers the common area, every tenants is entitled to a copy.  HUD or EPA can fine the landlord $11,000 for each violation.  Tenants can also sue the landlord for triple damages and recovery attorney and expert witness fees. 

Unfortunately, new tenants are not entitled to received the information until they are signing the lease.  And existing tenants won't get it until their next lease renewal.  The information helps them understand the problem and make sure that the hazards are properly managed but they essentially get it too late to make an informed choice where they want to live.  Therefore, IKE believes that it is important to provide the public with this information as soon as possible so they can make more informed decisions where they want to live.  IKE is making the information available below for the buildings it is aware were inspected by MCHD.  IKE encourages anyone - including tenants, owners and property managers - to send IKE a copy of the information the person may have on a particular building listed below or any other building.  IKE will add a link to the document.  Send documents to IKE by faxing them to 866-234-8505 or emailing them to mccabe@ikecoalition.org.

• Follow-up on order by MCHD.  Usually the follow-up indicates that the work was completed and lead hazards eliminated. 

• Link to city database.  Go to http://www2.indygov.org/PermitResearch/jsp/template.jsp to search for the latest information maintained by the city of Indianapolis on the property.  Type in the street number, street direction (E, W, N, S ) and the street name and click enter.  The information includes inspections, enforcement actions, and various permits.  It is a wonderful source of information for all types of issues not just lead.

You Can Live Safely in a Home With Lead-Based Paint.

Residents can live safely in a well-maintained apartment even if lead-based paint is present.  Lead hazards are present when:

• The lead-based paint is deteriorated - in order words it is peeling, chipping, cracking, chalking or flaking;

• Lead dust is present on window sill or floors at levels greater than EPA standards; or

• Lead is in the soil around the building at levels greater than EPA standards.

A good landlord can safely manage lead-based paint if repairs are properly done, the paint is maintained in good condition, and the soil and dust is regularly checked for lead.
